General Application Terms

1. App Usage and Restrictions

  • These terms automatically apply when downloading or using the app.
  • You may not copy or modify the app or our trademarks.
  • Source code extraction is prohibited.
  • Translation or derivative versions are not allowed.
  • All intellectual property rights belong to Pooli, Inc.

2. Service Changes and Charges

  • Pooli, Inc. may improve or change the app and services from time to time.
  • We may introduce or change prices with clear advance notice for any material change (including price changes for auto-renewing plans).
  • For material changes, we will give at least 14 days’ notice. If you do not agree, you may cancel before the change takes effect and we will provide a pro-rata refund of any prepaid, unused period.
  • We will never charge you without making it clear what you are paying for.

3. Data and Security

  • The app stores and processes personal data you provide.
  • You are responsible for keeping your device and app access secure.
  • Jailbreaking or rooting your device is not recommended and may compromise app functionality.

4. Internet Connectivity

  • Certain functions require an active internet connection (Wi-Fi or mobile).
  • Pooli is not responsible for limited functionality without a connection.
  • Your mobile provider’s terms and charges apply; you accept responsibility for any data charges.

5. App Updates and Termination

  • Updates may be released periodically; system requirements may change.
  • Users must accept updates to continue using the app.
  • Pooli may suspend or terminate access for cause (e.g., breach, fraud, misuse) with notice where reasonable.
  • For prepaid periods, we will provide a pro-rata refund of any unused portion unless termination is due to serious misuse or as otherwise not required by law.

Safety Notice; Waiver (to the extent permitted by law)

Handling pool and spa chemicals involves risks. Use products as labeled and follow local safety guidance. To the extent permitted by law, you agree that your use of Pooli’s recommendations is at your own risk. Nothing in this waiver limits any non-excludable consumer rights (including rights under the Australian Consumer Law).

Professional Service Provider Terms

1. Service Description

Pooli provides a platform that facilitates pool service management and payment processing between pool service technicians ("Technicians") and their customers. Pooli is not a pool service provider and does not employ technicians.

2. Subscription Requirements

  • Free tier allows management of up to 2 pools.
  • Additional pools require a Pro or Plus subscription.
  • Subscription fees are separate from transaction fees.
  • Subscriptions can be cancelled at any time; refunds are provided in accordance with our refund policy and any mandatory consumer rights that apply (including the Australian Consumer Law where relevant).

3. Payment Processing & Fees

  • Pooli charges a platform fee on transactions processed through the service; the current fee structure is shown in your account.
  • We may update fees with at least 30 days’ notice. If you do not agree, you may stop using the fee-based features before changes take effect.
  • Stripe accounts may be created/connected for payment processing; technicians are responsible for tax obligations and reporting.

4. Technician Responsibilities

  • Managing customer relationships and service delivery.
  • Handling customer complaints and service issues.
  • Managing refunds and billing disputes with customers.
  • Maintaining accurate service records and compliance with local regulations.
  • Maintaining appropriate insurance coverage.

5. Liability & Disclaimers

Pooli provides tools but is not responsible for technicians’ service quality, delivery, business outcomes, customer disputes or chargebacks. Nothing in these terms excludes liability that cannot be excluded by law.

6. Delivery Services (Pooli Local)

Pooli facilitates connections between service organizations and consumers for local delivery services:

  • Organizations are responsible for delivery quality, timing, and fulfillment.
  • Consumers contract directly with organizations; disputes and refunds are resolved between them.
  • Pooli is not liable for delivery mishaps, delays, damaged goods, or service quality issues.
  • Location services are used solely for proximity matching.

7. Customer Data & Privacy

Technicians must protect customer data and use it only for service delivery, in accordance with applicable privacy laws and our Privacy Policy.

8. Account Termination

Pooli may terminate accounts for terms violations. For prepaid periods, we provide a pro-rata refund unless termination is for serious misuse or as otherwise not required by law.

9. Dispute Resolution

Disputes may be resolved by negotiation or arbitration where agreed. For customers located in Australia, disputes may be brought in the courts of your state or territory and your rights under the Australian Consumer Law apply. Any arbitration or foreign venue clause does not prevent you from relying on non-excludable consumer protections.

10. Changes to Terms

We may update these terms with notice. Material changes (including price changes for auto-renewing plans) will take effect no sooner than 14 days after notice. If you do not agree, you may cancel before the effective date and receive a pro-rata refund of any prepaid, unused period.

Marketing Communications (Email/SMS)

We send marketing communications only with consent, include our identity in each message, and provide a functional unsubscribe that is actioned within 5 business days. Transactional/service messages may still be sent.

Pricing and Taxes

Prices may be shown in USD or AUD (as indicated at checkout). For Australian customers, prices do not include Australian GST unless stated. If our Australian turnover reaches the GST registration threshold, we will register and display GST-inclusive pricing for Australian customers and issue valid tax invoices.

Data Usage and Aggregation

By using Pooli services, users grant Pooli a non-exclusive right to use service usage data to operate and improve the Service. Pooli may generate aggregated insights from de-identified data that do not identify individual users or households; Pooli will not attempt to re-identify such data. We do not sell personal information. Data may be stored in or accessed from the United States and other countries. Where we disclose personal information cross-border, we do so in accordance with applicable law.


Australia Addendum

Australian Consumer Law (ACL). Nothing in these terms excludes, restricts, or modifies any rights and remedies you have under the ACL. Pooli will provide services with due care and skill and they will be reasonably fit for their disclosed purpose. If there is a failure to comply with a consumer guarantee, you are entitled to a remedy. For a major failure, you may cancel your subscription and receive a refund for the unused portion and compensation for any reasonably foreseeable loss. For a minor failure, we will remedy within a reasonable time (for example by re-performance or a refund/credit of the affected period).

Fair terms. We will not rely on any unfair term under Australian law. We will give at least 14 days’ notice of any material change. If you do not agree, you may cancel before the change takes effect and we will apply a pro-rata refund of any prepaid, unused period.

Cancellations and refunds (AU). You can cancel auto-renew at any time in the app or on the web. Refunds will be provided in accordance with the ACL rights above. Any “no refunds” wording elsewhere does not apply to Australian customers where the ACL provides a remedy.

Governing law and venue (AU). If you reside in Australia, disputes may be brought in the courts of your state or territory and the ACL applies. Any arbitration or foreign venue clause does not prevent you from using Australian consumer protections.

Marketing communications (Spam Act). We send marketing only with consent, clearly identify Pooli, and provide a functional unsubscribe processed within 5 business days.

Privacy. Pooli is a US-based service. We store data in the United States and may disclose to service providers overseas. We do not sell personal information. If we ever trade in personal information, we will comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, including the Notifiable Data Breaches scheme.

Pricing and GST. Prices for Australian customers are as displayed at checkout. If we are required to collect GST, we will display GST-inclusive pricing and issue valid tax invoices.
