General Application Terms
1. App Usage and Restrictions
- These terms automatically apply when downloading or using the app
- You may not copy or modify the app or our trademarks
- Source code extraction is prohibited
- Translation or derivative versions are not allowed
- All intellectual property rights belong to Pooli, Inc.
2. Service Changes and Charges
- Pooli, Inc. reserves the right to make changes to the app
- We may charge for services with clear advance notice
- Changes may be made at any time for any reason
- All charges will be clearly communicated
3. Data and Security
- The app stores and processes personal data you provide
- You are responsible for keeping your device and app access secure
- Jailbreaking or rooting your device is not recommended
- Device modifications may compromise app functionality
4. Internet Connectivity
- Certain functions require active internet connection
- Connection can be Wi-Fi or mobile network
- Pooli is not responsible for lack of functionality without connection
- Mobile provider terms and charges still apply
- Users accept responsibility for any data charges
5. App Updates and Termination
- App updates may be released periodically
- System requirements may change over time
- Users must accept updates to continue using the app
- Pooli may terminate app usage without notice
- All rights and licenses end upon termination
Waiver and Release of Liability to Pooli and Pooli, Inc.
In consideration of the risk and injury that may result in administering and handling chemicals that come into contact living beings or physical property; and in consideration of your desire to participate in using Pooli to administer chemical dosages; you understand this is a voluntary participation, and hereby waive any and all rights, claims or causes of action of any kind arising out of your participation in using Pooli and activities that result in using the app.
Professional Service Provider Terms
1. Service Description
Pooli ("the App") provides a platform that facilitates pool service management and payment processing between pool service technicians ("Technicians") and their customers. The App is not a pool service provider and does not employ technicians.
2. Subscription Requirements
- Free tier allows management of up to 2 pools
- Additional pools require a Pro or Plus subscription
- Subscription fees are separate from transaction fees
- Subscriptions can be cancelled at any time, but no refunds will be issued
3. Payment Processing & Fees
- Pooli charges a 7% fee on all transactions processed through the platform
- This fee may be adjusted by Pooli with notice to technicians
- Stripe accounts are created on behalf of technicians for payment processing
- Technicians are responsible for all tax obligations and reporting
- Fee structure may be updated with 30 days notice
4. Technician Responsibilities
- Managing all customer relationships and service delivery
- Handling customer complaints and service issues
- Managing refunds and billing disputes with customers
- Maintaining accurate service records
- Ensuring compliance with local regulations
- Managing subscription billing relationships with customers
- Maintaining appropriate insurance coverage
5. Liability & Disclaimers
Pooli is not responsible for service quality or delivery. Pooli does not guarantee customer satisfaction or payment. The App provides tools but is not responsible for business outcomes. Technicians indemnify Pooli against customer claims. Pooli is not responsible for customer disputes or chargebacks.
6. Customer Data & Privacy
Technicians must protect customer data. Customer information can only be used for service delivery. Compliance with data protection regulations is required. Pooli may access aggregate, anonymized data.
7. Account Termination
Pooli may terminate accounts for terms violations. No refunds will be issued upon termination. Technicians must complete pending services. Customer data must be handled according to privacy policy.
8. Dispute Resolution
All disputes will be resolved through arbitration. Venue for any legal proceedings will be Sacramento, CA. Technicians agree to resolve customer disputes directly.
9. Changes to Terms
Pooli may update these terms with notice. Continued use constitutes acceptance. Material changes require explicit acceptance.
